These Terms of Use (“Terms”) govern your access to and use of the website at ratedlocaltrades.co.uk and the services provided through it (together, the “Service”), operated by Rated Local Trades (“we”, “us”, “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. About Rated Local Trades

Rated Local Trades is an online directory that helps customers in the United Kingdom find and contact independent local tradespeople (“Tradespeople”). We provide an introduction and information service only. We are not a party to any agreement between a customer and a Tradesperson, we do not carry out any trade work ourselves, and we do not employ, supervise or act as the agent of any Tradesperson. Tradespeople listed on the Website are independent businesses responsible for their own work, conduct and contracts.

3. Using the Website

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of the Website by, anyone else. In particular, you agree not to:

• use the Website in any way that breaches any applicable law or regulation;
• submit false, misleading, fraudulent or defamatory information;
• impersonate any person or business, or misrepresent your connection with any person or business;
• upload or transmit any material that is unlawful, harmful, obscene, offensive or that contains viruses or other harmful code;
• collect or harvest data from the Website, or use automated systems such as scrapers or bots, without our permission;
• attempt to gain unauthorised access to the Website, its servers or any connected systems; or
• use the Website or any listing for unsolicited marketing.

4. Listings and information

Information about Tradespeople is largely provided by the Tradespeople themselves. While we want the directory to be useful and accurate, we do not independently verify all of the information provided, and we do not guarantee that any listing is accurate, complete or up to date. A listing is not a recommendation, endorsement or guarantee by us of any Tradesperson, their qualifications, their insurance or the quality of their work.

Before engaging any Tradesperson, you are responsible for carrying out your own checks. We strongly recommend that you confirm the Tradesperson’s insurance, qualifications, accreditations and references, obtain a written quotation, and agree the scope, price and terms of any work directly with them before it begins.

5. Reviews and user content

Reviews and other content submitted by users reflect the views of the individuals who post them and not of Rated Local Trades. Any content you submit must comply with our Review Policy. You retain ownership of the content you submit but grant us a non-exclusive, royalty-free licence to use, display and distribute it in connection with the Service. We may remove content that breaches these Terms or our policies.

6. No warranty

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations that the Website will be uninterrupted, error-free or secure, or that any Tradesperson will be available, suitable, qualified or able to carry out your work to a particular standard.

7. Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, these Terms do not affect your statutory rights.

Subject to the above, and to the fullest extent permitted by law:

• we are not responsible or liable for the acts or omissions of any Tradesperson, for any work carried out (or not carried out) by a Tradesperson, or for any contract, dispute, loss or damage arising between you and a Tradesperson;
• we are not liable for any loss or damage arising from your reliance on any listing, review, guide or other information on the Website; and
• we will not be liable for any indirect or consequential loss, or for any loss of profit, revenue, business, goodwill or data.

8. Indemnity (business users)

If you use the Service as a business (for example, as a listed Tradesperson), you agree to indemnify us against any claims, losses or costs arising from your breach of these Terms, your listings or content, or your dealings with customers.

9. Intellectual property

The Website and its content (excluding user-submitted content and third-party materials), including its design, text, graphics and logos, are owned by or licensed to Rated Local Trades and are protected by intellectual property laws. You may not copy, reproduce or exploit any part of the Website without our permission, except as permitted by law.

10. Third-party links

The Website may contain links to third-party websites. We do not control and are not responsible for the content or practices of those websites, and links do not imply endorsement.

11. Privacy

Our use of your personal data is governed by our Privacy Policy.

12. Suspension and changes

We may change, suspend or withdraw all or part of the Service at any time. We may also update these Terms from time to time; the version in force is the one published on this page. Your continued use of the Service after any change constitutes acceptance of the updated Terms.

These Terms, and any dispute arising out of or in connection with them, are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in your local courts.
